Terms of Service
Last updated: October 17, 2026
This is not legal advice. These terms govern your use of Swanki Cards Maker. By using the service, you agree to these terms.
1. Service Description
Swanki Cards Maker ("Maker", "we", "our", "the service") is a source-grounded flashcard generation tool. You provide text or PDF documents, and the service generates flashcards from your material. Generated cards remain private to your account until you choose to export them.
2. Your Content and Rights
You must own or have rights to use any material you upload. When you save a source, you acknowledge that:
- You own the material, have permission to use it, it is in the public domain, or you have a valid legal basis for your proposed use
- You will create and use cards fairly and lawfully
- You respect copyright and license conditions
- You will not use this service to infringe others' rights
- Educational purpose or an acknowledgment alone does not establish fair use or make an otherwise unlawful use lawful
Your sources and generated cards are private to your account. Any later sharing requires your separate authorization and review.
3. How Your Content Is Processed
When you request card generation:
- Your source text is sent to AI providers via OpenRouter to generate flashcards
- The AI provider processes your text and returns generated cards
- Generated cards are stored in your account for review, editing, and download
- We do not train AI models on your content
4. Data Storage and Deletion
Your data is stored in Supabase. The service is hosted on Railway and delivered through Cloudflare.
Deleting sources: You can delete source text from your account at any time through the workspace interface. Deletion is immediate unless:
- The source has unfinished generation requests (wait for them to finish or cancel them first)
- Source text is retained in a generation receipt (contact support for assistance)
Source retention: Sources are kept as long as your account exists. When you delete a source, its text is removed immediately, except for any copy saved in a generation receipt. There is no automatic deletion.
5. Credits and Payment
Card generation requires credits. You purchase credit packs through Stripe's secure checkout:
- Credits are reserved when generation starts, not when you prepare a request
- You are charged one credit per card delivered
- Unused reserved credits are returned to your balance
- Payment is processed by Stripe; your card details never reach Maker
Refunds: Unused credits are refundable on request to [email protected]. Used credits (credits consumed for delivered cards) are not refundable.
Payment disputes or chargebacks: If a payment is refunded or disputed, credit purchases and new generation requests may be paused while we review the account. Your saved sources, cards, and downloads remain accessible.
6. Account and Access
You sign in with your email address using a one-time code. No password is required. You may have one account per email address.
Account limits:
- Up to 100 saved sources per account
- Source text must be between 200 and 100,000 characters (longer documents are automatically split)
- Up to 3 prepared requests at a time
Account deletion: To close your account, email [email protected]. Closing your account disconnects it (sign-in is disabled), but account data is retained.
7. Analytics and Tracking
When analytics are enabled (via the POSTHOG_KEY environment variable), we use PostHog to track usage events such as signups, purchases, and card generation. We collect:
- Event counts (number of cards generated, credits purchased, etc.)
- Event types (signup, purchase, source added, etc.)
- UTM attribution parameters for acquisition tracking
We do NOT collect:
- Your source text or card content
- Your email address in analytics (users are identified by UUID)
- Session recordings (completely disabled)
- Automatic form captures (disabled)
8. Test Mode
The service may operate in test mode for development and staging. In test mode, payments use Stripe's test environment and no real charges occur. Simulated test cards may be generated for workflow testing and are marked as such.
9. Service Availability
We strive to keep the service available, but we do not guarantee uninterrupted access. The service may be unavailable for maintenance, updates, or due to factors beyond our control. We are not liable for any downtime or data loss.
10. Prohibited Uses
You may not:
- Upload material you do not have rights to use
- Use the service to infringe copyright or other intellectual property rights
- Attempt to reverse engineer, abuse, or circumvent the service
- Use the service for unlawful purposes
- Share your account access with others
11. Changes to Terms
We may update these terms at any time. Changes will be reflected by the "Last updated" date. Continued use of the service after changes constitutes acceptance of the updated terms.
12. Limitation of Liability
The service is provided "as is" without warranties of any kind. AI-generated cards may contain mistakes or omit important context. You must review cards against your source before using or sharing them. We are not liable for any damages arising from your use of the service, including but not limited to:
- Errors or inaccuracies in generated cards
- Loss of data or content
- Service interruptions or downtime
- Unauthorized access to your account
13. Governing Law and Disputes
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the service will be resolved in the state or federal courts located in Pennsylvania, and you consent to the jurisdiction of those courts.
